Domestic Violence Attorneys

Defending Your Rights

Unfortunately, domestic violence situations are all too common in family law cases particularly in matters of divorce. Cases that involve violence and the threat of violence require legal counsel from an experienced family law attorney. At the Abear Law Offices, we take cases involving domestic violence very seriously and fight hard to protect our clients’ safety and interests.

Protecting Our Clients in Domestic Violence Situations

When our clients’ safety or the safety of their children is in jeopardy, a restraining order or order of protection is often warranted. If you are in danger, a Temporary Restraining Order (TRO) can be filed immediately at your local courthouse to prevent the person threatening you from contacting you or coming within a certain distance to you. These orders may also temporarily suspend custody rights if minor children are involved.

Temporary Restraining Orders can be obtained on the same-day without the presence of the other party, but an Order to Show Cause hearing is typically scheduled for within 15 to 20 days. This hearing allows both sides to present evidence of whether a more permanent order of protection is warranted. Attorney Anthony Abear is skilled in preparing and presenting the necessary evidence to have a TRO upheld and keep legal protections in place for his clients.

Managing Domestic Violence in Family Law Cases

Once your immediate safety is addressed, other legal issues must also be resolved. Allegations of domestic violence can dramatically impact divorce proceedings and child custody and visitation matters.  We strongly advocated for our clients interests and the interest of any children involved.

If you or your children are experiencing domestic violence or the threat of domestic violence, contact us today. We can help you get the protection you need right away and put into place lasting legal protections for you and your family.
